Answer

Who is covered by the subscription rules?

A contract that meets one of four gateways in section 48B and is not excluded by section 48C. The consumer requirement covers an individual buying mainly for personal, home or household use. The small business requirement covers a standard form contract with a subscriber under 100 staff or under $10 million turnover.

What are the four gateways?

Indefinite recurring supply, fixed-period supply that continues automatically, an initial free period that turns into paid supply, and an introductory period at a lower rate that rises. Each includes automatic liability and a right to end.

Which contracts are excluded?

A lease, a property licence, hire-purchase, payment by instalments, childcare, school tuition, and a kind prescribed by regulation.

Do business customers get the disclosure?

Section 48D applies to an offer that would result in a subscription contract, without the consumer or small business limitation used by sections 48E and 48F. A business offer can be within it.
