Starts 1 July 2027

The Act that changes how you sell, price and cancel.

A free section-by-section reference to the Competition and Consumer Amendment (Unfair Trading Practices) Act 2026, a check that tells you which parts apply, and a paid kit with the register, the evidence and the dated plan.

Read from the real Act, not invented. Every answer points to the provision it came from, so you can check any line against the official text.

Free reference and check. Kit USD 299 one off. Watch USD 29 a month. Not legal advice; does not certify.

Know the duty, the date and the evidence before the first customer asks. The record is the Act itself, read in full, so a product, legal or compliance lead can act without waiting for a first legal read.
What changes

Three duties, one start date.

Does the Act apply to you, and from when?

Seven questions. The check returns the parts that apply, the date, the first actions and the evidence to keep. It runs in your browser and sends nothing anywhere.

Leave blank if you do not know. The check will say what is missing rather than guess.

The check applies the Act as drafted. It does not decide whether a particular design is manipulative, whether a charge is a payment surcharge or whether a contract is a standard form contract. Not legal advice; does not certify.

The paid kit

Turn the Act into a register your team can run.

The kit carries all 23 sections with the citation, the party bound, the requirement in our words, the evidence a regulator asks for, the actions and the dates. It also carries the evidence list on its own and a dated plan from now to the first review after the start date.

Questions

What buyers ask first

What does the Act change?
It inserts a general ban on unfair trading practices into the Australian Consumer Law (section 28B), adds a duty to display transaction based charges with a base price (section 48A), and inserts a subscription contracts regime (sections 48B to 48H). The whole Act commences on 1 July 2027.
When does it start?
1 July 2027. The commencement table in section 2 says the whole Act commences on that date. The Act was assented to on 6 July 2026, so there is a lead time of almost a year.
Who is caught by the unfair trading ban?
A person in trade or commerce who supplies, or offers to supply, goods or services to a consumer. The ban does not apply if the consumer is a body corporate, or if the sale happens in the course of the consumer carrying on a business. The supplier bears the evidential burden for those exclusions.
What is a transaction based charge?
A charge, or part of one, charged to the purchaser for the supply, not for the goods or services as such, and due at the same time as the price. Optional charges, payment surcharges, taxes and prescribed charges are excluded. The duty is to display four things about it with the base price.
Which subscriptions are covered?
A contract that meets one of four gateways in section 48B and is not excluded by section 48C. The subscription duties include disclosure at the offer, prescribed information while the contract runs, and an exit route that is easy to find and use. Sections 48E and 48F apply where the consumer or small business requirement is met.
What do I get for USD 299?
The obligation kit: all 23 sections in a register, the evidence list, the dated plan and a gap view, as PDF, CSV and XLSX. The specimen shows a labelled sample. The change watch is USD 29 a month and emails you when the record changes.
