Answer

When does the Act start?

The whole Act commences on 1 July 2027. The commencement table in section 2 says so, and it applies to the Act as originally enacted. The Act was assented to on 6 July 2026, so there is almost a year to prepare.

Do the duties start together?

Yes. The commencement table says the whole Act commences on 1 July 2027. The application provisions then decide which conduct and which contracts are caught from that date.

What about contracts signed before the date?

Section 312 keeps the subscription provisions away from a contract entered before commencement, but brings it in on a renewal, extension, continuation or variation after the date, from the day that event takes effect.

What about conduct under an old supply?

Section 311 applies the unfair trading ban to conduct on or after commencement, whether the supply or offer was made before, on or after that date.
