Answer

What is drip pricing under the Act?

Drip pricing is the practice of showing a base price and adding a transaction based charge later. Section 48A requires four things to be shown with the base price: the amount or method, that it is per transaction, whether it is or may be payable, and whether the base price includes it.

When must the information appear?

While the base price is displayed, in a legible, prominent and unambiguous way, close to the price. The duty applies each time a base price is displayed, so it travels through the checkout.

What is a transaction based charge?

A charge, or part of one, charged to the purchaser for the supply, not for the goods or services as such, and due at the same time as the price. Optional charges, payment surcharges, taxes and prescribed charges are excluded.

Who is outside the duty?

An offer made exclusively to a body corporate. The person relying on the exception bears an evidential burden.
